Please read these terms and conditions carefully before using PayKumba's services.

1. Introduction
Welcome to PayKumba ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the PayKumba platform, including our website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
2. Definitions
In these Terms, the following definitions apply:
- "Diaspora User" refers to individuals residing outside Zimbabwe who use our Services to pay for goods and services for recipients in Zimbabwe.
- "Recipient" refers to individuals in Zimbabwe who receive the benefits of payments made through our Services.
- "Transaction" refers to any payment or purchase made through our Services.
- "Service Provider" refers to any third-party entity that provides goods or services that can be paid for through our platform, including but not limited to utility companies, retailers, schools, and healthcare providers.
3. Account Registration and Eligibility
To use our Services, you must register for an account. You must provide accurate, current, and complete information during the registration process and keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet all eligibility requirements.
4. Service Description
PayKumba provides a platform that enables Diaspora Users to pay directly for goods and services for Recipients in Zimbabwe. Our Services include but are not limited to facilitating payments for:
- Prepaid electricity (ZESA)
- DSTV and entertainment subscriptions
- Mobile airtime and data
- Groceries and essentials
- School fees and tuition
- Medical aid and healthcare
- Funeral cover and insurance
5. Transaction Process
Our platform supports two transaction flows:
5.1 Recipient-Initiated Transactions
Recipients select goods or services on our platform and provide the Diaspora User's contact information. The Diaspora User receives a notification and completes the payment. Once payment is confirmed, the Recipient receives the selected goods or services.
5.2 Diaspora-Initiated Transactions
Diaspora Users select and pay for goods or services directly through our platform. Recipients are notified and can claim or receive the goods or services.
6. Fees and Payments
We charge service fees for using our platform. All fees are clearly displayed before you complete a transaction. We accept various payment methods, which may include credit/debit cards, bank transfers, and other electronic payment methods.
All payments are processed through secure third-party payment processors. By using our Services, you authorize us to charge the applicable fees to your chosen payment method.
7. Service-Specific Terms
7.1 Prepaid Electricity (ZESA)
We facilitate the purchase of ZESA tokens but are not responsible for power outages, system failures, or any issues with the electricity service itself. Token delivery is typically immediate but may be delayed due to ZESA system issues beyond our control.
7.2 DSTV and Entertainment
Payments for DSTV and other entertainment services are subject to the terms and conditions of the respective service providers. We are not responsible for content, programming changes, or service interruptions.
7.3 Mobile Airtime and Data
Airtime and data purchases are typically processed immediately but may be subject to delays due to mobile network issues. We are not responsible for network coverage, quality of service, or any changes to mobile operator policies.
7.4 Groceries and Essentials
For grocery purchases, Recipients must collect items from the designated retailer. Product availability, quality, and pricing are the responsibility of the retailer. We do not guarantee specific product availability.
7.5 School Fees and Tuition
School fee payments are subject to verification by the educational institution. We are not responsible for admission decisions, academic policies, or any disputes between students and educational institutions.
7.6 Medical Aid and Healthcare
Healthcare payments are subject to the terms and conditions of the healthcare provider or medical aid society. We do not provide medical advice and are not responsible for the quality of healthcare services.
7.7 Funeral Cover and Insurance
Insurance payments are subject to the terms and policies of the insurance provider. We do not underwrite insurance policies and are not responsible for claim processing or coverage decisions.
8. Refunds and Cancellations
Once a transaction is processed, refunds are generally not available except in cases of service non-delivery or technical error. Refund requests must be submitted within 7 days of the transaction date. Each refund request is evaluated on a case-by-case basis.

9. User Responsibilities
You agree to:
- Provide accurate information for all transactions
- Use our Services only for lawful purposes
- Not engage in fraudulent activities or misrepresent information
- Not use our Services for money laundering or financing illegal activities
- Comply with all applicable laws and regulations
10. Privacy and Data Protection
We collect and process personal information in accordance with our Privacy Policy. By using our Services, you consent to our collection, use, and sharing of information as described in the Privacy Policy.
11. Intellectual Property
All content, features, and functionality of our Services, including but not limited to text, graphics, logos, and software, are owned by PayKumba and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of our Services without our prior written consent.
12. Limitation of Liability
To the maximum extent permitted by law, PayKumba and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of our Services.
Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us for the transaction giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless PayKumba and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of our Services, your violation of these Terms, or your violation of any rights of another.
14. Termination
We may terminate or suspend your account and access to our Services at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.
15. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website or through other communications. Your continued use of our Services after such modifications constitutes your acceptance of the modified Terms.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Zimbabwe. Any dispute arising out of or relating to these Terms or our Services shall be resolved through arbitration in accordance with the rules of the Arbitration Centre of Zimbabwe.
